In what areas of the organization are responsible

The most common type of liability is considered material, while an employee or group of employees is appointed who is personally responsible for valuables, money and property of the company.

It is important that an employee can be responsible for the property and values ​​of the organization only on the basis of a written agreement on the full liability. The employee must agree to take on such a duty, so an order alone is not enough to impose liability. Responsibility of individual employees (deputy manager, chief accountant) according to Art. 243 of the Labor Code of the Russian Federation can be written directly into the employment contract. When the terms of such liability are included in a written contract with an employee, it is not necessary to issue an additional order, but the employer can do this if it is convenient for him to reinforce the contract with an order when conducting document management.

Responsibility is far from the only case when a leader issues an order to appoint a responsible person. Individual employees are also responsible for:

  • labor protection and compliance with safety regulations (only an employee who has completed safety training, passed the exam and received the necessary certificate, and also has the necessary electrical safety clearance group is allowed to control);

The form of the order on the appointment of a responsible person and the rules for filling out

The order on the appointment of a responsible person does not have an officially established form. It is drawn up arbitrarily, but subject to the rules that apply to all primary documents. These rules are established by law. dated 06.12.2011 06.12.2011 N 402-FZ. The form must contain:

  • name of the organization, basic information about it, city of location;
  • date and document number;
  • Full name CEO or a person authorized to issue orders;
  • preamble, stating short goal issuance of the order and contains a reference to the legal norm on the basis of which it was issued (for example, a reference to the Labor Code of the Russian Federation);
  • essence of the order;
  • manager's signature;
  • signatures of employees in respect of which the order is drawn up, confirming their familiarization with the document.

The form is signed by the head of the organization - the general director.

Sample order on the appointment of a financially responsible person

Here is an example of an order to appoint a responsible person in the field of control material assets. The list of positions with employees of which it is possible to conclude written agreements on full individual liability for the shortage of entrusted property is given in Appendix N 1 to Decree of the Ministry of Labor of December 31, 2002 N 85. With one order, the manager can assign responsibility for the storage of material assets immediately to a group of people. It is important that according to Art. 245 of the Labor Code of the Russian Federation, without a written agreement on full collective liability, which is concluded between the employer and all members of the team, the document cannot have legal force. Obligations of the employer when appointing a responsible person

Order on the appointment of a responsible person

However, in some cases this can be dispensed with: it is clearly indicated when it is not necessary to reissue an order to appoint a responsible person.

The frequency of reissuing an order for the enterprise on the appointment of responsible persons

Labor legislation does not provide for the annual reissuance of an order for the enterprise on the appointment of responsible persons. The responsible person shall perform these duties until the respective order is canceled or the labor relations(Art. 8, 57, 72 of the Labor Code of the Russian Federation). Thus, annually reissue an order to appoint a person responsible for the implementation of a particular labor function, not necessary.

Transfer of authority of a responsible person to another employee

The duties of the sick performer are assigned to another employee by order. An order for a materially responsible person, a sample of which the organization can develop itself, is not a mandatory document. However, it often precedes the direct conclusion of liability agreements. The order on the appointment of a financially responsible person (we will give a sample below) usually contains a list of positions and even specific full names. employees with whom such contracts are to be concluded, the need to conclude contracts on full liability is justified, the date from which full liability will be assigned to employees is indicated.
